Working Time Recording: It’s No Longer Optional!
The rulings of the European Court of Justice (ECJ) and the German Federal Labour Court established that all working time must now be recorded. However, from the DBV’s perspective, many important questions surrounding this issue remain unresolved.
One thing is clear, as DBV expert Ute Beese explains: working hours may be recorded electronically, via a time clock, or through self-reporting—but not recording them at all is no longer an option. Employers may also delegate the responsibility for recording working hours to employees. Employees continue to have flexibility in determining when they work, meaning that trust-based working hours (flexible working without fixed time monitoring) remain possible.
Information for Employees and Works Councils on Mobile Working / Home Office
The pandemic led to an unprecedented expansion of working outside the traditional workplace – whether from home, other remote locations, or while travelling.
Although employees and their representatives had long advocated moving away from the traditional requirement of being physically present in the office, it has become clear that this rapid shift has been far from ideal. In many cases, the new challenges outweigh the benefits. Employees often find themselves trying to work on a laptop at the kitchen table while caring for children, lacking adequate insurance coverage, bearing many work-related costs themselves, and being left without sufficient support from their employer when problems arise.
DBV has therefore developed a clear framework for organising permanent home office and mobile working arrangements, ensuring that they are properly supported both financially and socially to create sustainable and productive working conditions.
The package includes model provisions for a works agreement that works councils can use during negotiations with employers. DBV has also prepared a dedicated practical guide for employees.
Guide to the Rights of a Works Council
The rights of works councils have changed and, in some respects, been expanded during the pandemic. DBV expert Ute Beese has compiled the relevant legal provisions and clearly summarised the scope of works council co-determination rights.

Be Careful When Working from Your Holiday Home!
The idea of escaping the confines of the office or home office is certainly understandable. Some people own a holiday home and may assume that they can work there just as easily as from their home office.
Within Germany, employers cannot generally prohibit employees from working from a holiday home. Nevertheless, it is advisable to discuss such arrangements with your employer and to ensure that, if necessary, you can return to your regular workplace at short notice.
If your holiday home is located abroad, coordinating with your employer is strongly recommended. This may be necessary because of company policies, tax implications, or other legal considerations.
